The defendant argued that the accident was the plaintiff’s fault for failing to avoid the defendant’s turning vehicle. The defendant also argued that the plaintiff was not injured in the accident; that the plaintiff’s knee condition was “degenerative” in nature (in other words, that it was not caused as a result of the accident); and that the minimal amount of medical treatment undergone by the plaintiff demonstrated that his injuries were insignificant.
