A student was injured during a high school musical performance when a stage prop collapsed while being used by multiple students. The case presented significant challenges, including issues of notice, control, and comparative fault, as well as defenses based on assumption of risk in a school-sponsored activity. Our firm conducted extensive investigation, discovery, and motion practice to establish responsibility despite these obstacles. As a result of our preparation and ability to overcome multiple liability defenses, we persuaded the defendants to resolve the matter at a court settlement conference before trial for $500,000.00, a result that significantly exceeded expectations given the contested liability.
